
MAINE (WABI) - The initial stage of Maine Republican Representative Laurel Libby’s legal action against Democratic Speaker of the House Ryan Fecteau has been submitted to a federal judge based in Rhode Island.
On Friday, U.S. District Court Judge Melissa DuBose presided over hearings concerning Libby’s plea for a temporary restraining order.
In February, members of the House voted to censure Libby Following her social media post about a transgender high school athlete, Fecteau prohibited Libby from voting or addressing the House floor.
In Friday's virtual proceeding, an attorney representing Libby described the situation as "unprecedented." They contended that Fecteau is infringing upon Libby's First Amendment rights and failing to uphold the constitutional guarantee of representation for her 9,000 constituents.
An Assistant Attorney General from Maine represented Fecteau, asserting that the Speaker benefits from legislative immunity.
She mentioned that censure along with the associated penalties are establishedHouseruleswhichLibbynhas previously consented to.
Libby might regain her ability to vote and address the House chamber by offering an apology. that she has declined to perform .
Following Libby’s legal action submitted last month , the case was transferred to another state due to All of Maine’s federal judges have stepped aside. .
The judge is set to deliver a decision in the upcoming weeks.
